Allow me to throw a complication into the mix. It could be argued that Jean isn't 'technically' dead because she's the Phoenix. And the Phoenix by it's own definition cannot die. So it may or may not end her marriage with Scott legally. But given that she's pretty much out of the picture, it could be argued that her and Jean are 'unwillingly separated.' I'm not sure if that is a legal term, but it does nix things if one partner disappears and is no longer legally recognized as active. Maybe there are some instances with missing people or people who are spies who go away for long periods. Who knows? If Mystique is right and nobody can prove definitively that Jean Grey is dead, then maybe she would be classified as 'ultimately missing.'

Wow, my head hurts now. lol Maybe I should stop trying to point out technicalities. I wonder if Marvel has ever used lawyers in the comics to get a clear understanding of a situation? I'm not sure, but this is probably one of those 'let's not and say we did' moments. Sorry if I'm rambling. It's just a thought provoking idea, what Jean's status is if she as the Phoenix can't die.
